Terms of Use for WyraChat

1. Introduction
These Terms of Use (“Terms”) govern the use of WyraChat, an AI-powered WhatsApp automation platform developed and operated by AMAST Sdn Bhd (Registration No. 1177030-M).
By registering for, accessing, or using WyraChat, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

3. Description of Service
WyraChat is a Software-as-a-Service (SaaS) platform that enables individuals and businesses to automate WhatsApp communications using artificial intelligence technologies.
Features may include:
- Automated responses to incoming WhatsApp messages
- AI-assisted customer support
- Sales and marketing conversation automation
- Contact and conversation management
- Business workflow automation
- Reporting and analytics features
AMAST reserves the right to modify, enhance, suspend, or discontinue any feature of the Service at any time.
4. Eligibility
Users must have the legal authority to enter into a binding agreement.
If you are registering on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms.
5. Account Registration
To use WyraChat, users may be required to provide:
- Name of individual or company
- Email address
- Telephone number
- Other information reasonably required for account administration
Users are responsible for ensuring that all information provided is accurate and up to date.
6. WhatsApp Integration
WyraChat operates using WhatsApp services and related technologies.
By connecting a WhatsApp account to WyraChat, you:
- Confirm that you are authorized to use the connected WhatsApp account
- Grant WyraChat permission to access and process incoming messages
- Authorize WyraChat to generate and send responses on your behalf
- Accept responsibility for messages sent through your connected account
You remain solely responsible for your WhatsApp Business Account, phone numbers, contacts, and communications.
7. Artificial Intelligence Responses
WyraChat uses artificial intelligence technologies to generate responses to incoming messages.
You acknowledge and agree that:
- AI-generated responses may contain inaccuracies, omissions, or unintended content.
- AI responses should not be considered legal, financial, medical, or professional advice.
- You are responsible for reviewing and configuring AI behavior according to your business requirements.
- AMAST does not guarantee the accuracy, completeness, or suitability of AI-generated responses.
Users are responsible for monitoring the performance and appropriateness of automated communications.
8. Acceptable Use
Users agree not to use WyraChat for:
- Illegal activities
- Fraudulent or deceptive practices
- Spam or unsolicited communications
- Distribution of malware or harmful software
- Harassment, abuse, or threats
- Infringement of intellectual property rights
- Activities that violate applicable laws or regulations
- Activities that violate Meta, WhatsApp, or third-party platform policies
AMAST reserves the right to suspend or terminate accounts that violate these requirements.
9. User Responsibilities
Users are responsible for:
- Maintaining the security of their accounts
- Protecting access credentials
- Ensuring compliance with applicable privacy and data protection laws
- Obtaining all necessary consents from customers, contacts, and end users
- Ensuring that messages sent through WyraChat comply with applicable laws and platform requirements
Users acknowledge that they are the data controller for customer communications processed through their use of WyraChat.
10. Intellectual Property
WyraChat, including its software, branding, trademarks, documentation, and related materials, is owned by AMAST Sdn Bhd and protected by applicable intellectual property laws.
These Terms do not grant users any ownership rights in the Service.
Users retain ownership of their own business data, content, and communications.
11. Service Availability
AMAST will use commercially reasonable efforts to maintain service availability.
However, AMAST does not guarantee that WyraChat will operate without interruption, delay, error, or security incident.
Temporary interruptions may occur due to:
- Scheduled maintenance
- System upgrades
- Network failures
- Third-party service disruptions
- Force majeure events
12. Suspension and Termination
AMAST may suspend or terminate access to the Service if:
- These Terms are violated
- Required fees remain unpaid
- The Service is used unlawfully
- Continued access poses security or operational risks
Users may terminate their account at any time by contacting support@amast.com.my.
Termination does not relieve users of obligations accrued prior to termination.
13. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, AMAST disclaims all warranties, whether express or implied, including warranties of:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy
- Reliability
- Availability
AMAST does not warrant that the Service will meet every user requirement or expectation.
14. Limitation of Liability
To the fullest extent permitted by applicable law, AMAST shall not be liable for:
- Indirect damages
- Consequential damages
- Loss of profits
- Loss of business opportunities
- Loss of goodwill
- Loss of data
- Business interruption
arising from or related to the use of WyraChat.
In all circumstances, AMAST’s total aggregate liability shall not exceed the total subscription fees paid by the user to AMAST during the twelve (12) months immediately preceding the event giving rise to the claim.
15. Indemnification
Users agree to indemnify and hold harmless AMAST, its directors, officers, employees, and affiliates from any claims, damages, liabilities, costs, and expenses arising from:
- Use of the Service
- Violation of these Terms
- Violation of applicable laws
- Infringement of third-party rights
- Content transmitted through the user’s account
16. Privacy
Use of WyraChat is also governed by the WyraChat Privacy Notice.
Users are encouraged to review the Privacy Notice to understand how information is collected, processed, and protected.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia.
Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
18. Changes to These Terms
AMAST may modify these Terms from time to time.
Updated versions will be published on the official WyraChat website and become effective upon publication.
Continued use of the Service following publication constitutes acceptance of the revised Terms.
